Tácito fue uno de los escritores más reconocidos en los círculos intelectuales de la América revolucionaria. No se conservan muchas referencias explícitas en los escritos del periodo, pero su influencia es perceptible en los argumentos empleados para legitimar la independencia del Imperio británico. En el siguiente trabajo, se identificarán los elementos de la obra de Tácito que fueron recuperados por los padres fundadores durante la revolución. Las traducciones consultadas de clara ideología whig, modelaron la interpretación de la obra de Tácito (...) y su aplicación en la práctica política. Además, se analizará su empleo en el debate político de formas bien distintas, pero siempre por su utilidad en la construcción de la nueva república. (shrink)

This essay represents an attempt to bring prostitutes’ and clients’ voices into the philosophical discourse about prostitution. We wish to add the voices of individual prostitutes and clients in order to expand the contemporary philosophical understanding of prostitution as a complex and problematic ethical concern. The first section of this essay explains the concepts of subjectivity, sexuality, and violence that underpin our analysis of prostitution. The second section scrutinizes the prostitute’s and client’s motivating goals and the means they use to (...) accomplish them. The third, and final, section presents a phenomenological description of prostituted sex from the prostitute’s and client’s respective viewpoints. (shrink)

Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning and particularly so within Common Law. These studies are often motivated by research in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently, Rahman et al. developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the (...) authors suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary Common Law. In the present paper we will further motivate the deployment of the dialogical framework developed in Rahman et al. within Civil and Common Law. After a presentation of Scott Brewer’s take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis, we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based on Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case in Common Law. Moreover, quite surprisingly, the case under study suggests that even cases of Law interpretation fit the argumentation pattern of qiyās al-‘illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. O artigo reflete sobre o atual contexto da Educação Superior e seus desafios na formação de novos perfis de docentes. Optamos por indagar fenomenologicamente a formação docente em uma instituição confessional a fim de perceber, na pulsão das vivências dos estudantes, o lugar que a formação humana e da consciência ocupa na trajetória acadêmica. Seguindo essa pista e dialogando com profissionais e estudantes percebemos a necessidade de um maior aprofundamento dos pressupostos antropológico-filosóficos da educação. A partir disso, fizemos um contraponto (...) entre o modelo reducionista e o complexo, fundamentando as concepções de conhecimento e educação no diálogo entre dois grandes pensadores: Edith Stein e Edgar Morin. Os resultados revelam a necessidade de um diálogo multi e transdisciplinar nos programas de formação docente, bem como a necessidade de pensar a formação humana a partir do paradigma da complexidade, interligando saberes que fomentem a reforma do pensamento. A formação humano-integral requer projetos que incluam todas as dimensões do ser humano. Desse modo, o ato educativo, ensino e aprendizagem, assume proporções que ultrapassam a experiência de sala de aula e perduram em sua formação. A reflexão realizada fez emergir com maior clareza os desafios de nosso tempo: um pensar rigoroso sobre o “humano” e sua formação em uma perspectiva onto-antropológica que tenha como base uma visão de mundo, de ser humano e de transcendência comprometidos com valores pautados na ideia de “casa comum”. The aim of this study is to try to make use of real numbers for representing an infinite analysis of individual notions in an infinity of possible worlds.As an introduction to the subject, the author shows, firstly, the possibility of representing Boole's lattice of universal notions by an associate Boole's lattice of rational numbers.But, in opposition to the universal notions, definable by a finite number of predicates, an individual notion, cannot admits this sort of definition, because each state of an (...) individual subject is characterized by the values taken by an infinite number of predicates, each of whom may appear or disappear in the next state.The notion of “degree of identification of an individual notion” is then introduced and arithmetized by a rational number.As an individual notion can be defined by a convergent succession of degrees of identification, the real characteristic number of such an individual notion can be defined by the corresponding convergent succession of rational numbers, satisfying Cauchy's conditions for the convergence of successions. This article deals with Robert Grosseteste’s account of ‘spatial differences’, such as ‘up’, ‘down’, ‘right’, ‘left’, ‘before’, and ‘behind’. More specifically, attention is focused on Grosseteste’s De differentiis localibus, which is a concise scientific treatise arguing for the objectiveness of the differences of place pertaining to all living bodies, including heavenly ones. The article has a two-fold goal: to present the contents of such an understudied opuscule, and to check if there is some compelling reliance on any of the Latin (...) versions of Aristotle’s On the Heavens. Such an analysis reveals that Grosseteste’s reading of Aristotle’s On the Heavens is angled by Averroes’ Long Commentary on the Physics, on which Grosseteste relies as well to build his conception of mathematical and natural differences. This article deals with the first Latin reception of Pseudo-Aristotle’s On Indivisible Lines and its impact on the medieval debate about the continuum. Robert Grosseteste’s and Albert the Great’s references to this pseudo-Aristotelian text show that it could be regarded as a source for where to find information about the indivisibilist tenet, as well as an expansion of Aristotle’s anti-atomistic critiques scattered throughout his authentic works. The use of On Indivisible Lines made by Henry of Harclay and Adam of Wodeham (...) confirms this trend: the reading of this text could be twofold according to the tenet defended. While Henry argues against Pseudo-Aristotle to defend indivisibilism, Adam expands on pseudo-Aristotelian arguments to show the incongruities implied by indivisibilism. (shrink)

Reference to human rights, not as abstract consensus but as shared object, issue for action and principle of innovation, is ignored in Huntington’s theory of the clash of civilizations. The psychosocial processes of relegation to alterity are a form of exclusion which, beyond discrimination and contempt, deny the possibility of a common world. They prevent actors from experiencing their diversity of positioning as a rational diversity and prevent societies from democratically inhabiting the divisions that run through them. The author argues, (...) relying on authors like Etzioni, Moscovici and Crespi, that recognition of minorities’ influence will be the best bulwark against the divisions that undermine contemporary societies’ democratic purpose when they are eliminated or radicalized. She analyses the relations between connected phenomena such as persuasion and the common world, the struggle for recognition in the legal sphere, and the denial of esteem. (shrink)

Michael Warner, a literary critic with a keen sense of history, wrote in 1987 that “New Historicism is a label that historians don't like very much because they understand something different by historicism. But nobody's asking historians….” This essay is an answer to questions nobody asked me, questions about interdisciplinarity and the differences between literary critical and historical practices. A return to historically informed literary criticism, which many critics still consider a dominant trend in the profession, emerged in the early (...) 1980s following the publication of Stephen Greenblatt's acclaimed Renaissance Self-Fashioning . Reacting as it did against the decontextualized abstractions of New Criticism and Deconstruction, the movement soon labeled New Historicism sought to breathe new life into canonical texts by relating them to non-literary texts and social practices of their day. This historicist inclination should have formed the basis for a coming together of the movement's practitioners with historians interested in literary representations. But no such merger has occurred: New Historicists evince little interest in the systematic, archivally based study of history, and historians have at best shown indifference to the work of Greenblatt and his followers. Resumen Este artículo expone la presencia de Hegel en la teoría psicoanalítica de Lacan: en primer lugar, el uso que este último hace de la dialéctica del amo y el esclavo para iluminar la dimensión imaginaria de la conciencia y el deseo, en segundo lugar, la recepción de la concepción hegeliana del lenguaje en conexión con la función simbólica y la constitución de la subjetividad, y finalmente la postura de ambos respecto de la relación entre saber y verdad. Los tres (...) aspectos contribuyen a iluminar la interpretación del concepto de sujeto en Lacan a la luz de la influencia hegeliana.This article exposes the presence of Hegel in the psychoanalytk theory of Lacan: first, the use that the latter makes of the dialectic of the master and the slave to illuminate the imaginary dimension of consciousness and desire, secondly, the reception of the Hegelian conception of language in connection with the symbolic function and the constitution of subjectivity, and finally the position of both with respect to the relationship between knowledge and truth. The three aspects contribute to illuminate the interpretation of the concept of subject in Lacan in light of the Hegelian influence. (shrink)

Resumen A partir de la inclusión del término “género” en el ordenamiento jurídico de diversos países, incluido Chile, se expone la génesis desarrollo de dicho término y se da a conocer la posición de la Iglesia Católica sobre el mismo. En tercer lugar, se examinan algunas de las principales formas de la teoría contemporánea del reconocimiento con vistas a su posible contribución a la reflexión sobre el sentido y los alcances de las teorías de género, en diálogo con la posición (...) de la iglesia al respecto.In view of the inclusión of the term “gender” in the legal system of several countries, including Chile, the genesis and development of said term is exposed and the position of the Catholic Church on it is disclosed. Third, some of the main forms of contemporary recognition theory are examined with a view to theirpossible contribution to reflection on the meaning and scope of gender theories, in dialogue with the position of the Church in this regard. This article introduces Agentive Cognitive Construction Grammar, an emerging field that seeks to connect the linguistic system with speaker-meaning. The stated purpose is thus to tackle a pervasive disconnect in both cognitive linguistics and construction grammar, whereby the linguistic system and speaker selections are separated in the belief that language is essentially a mental process associated with the brain, and hence, separated from bodily experience. I contend this view by introducing a triadic model of construction in which form and function (...) are inextricably bound up with agency. This is possible because language is tethered to senses of movement and balance that connect experiences with the physical world with the mental. A major insight of the paper is that argument structure constructions partake of both linguistic and non-linguistic signs, which provides speakers with a means to verbalize their thoughts and distribute agency in specific events. La normativa sobre agricultura orgánica de los principales mercados está diseñada conforme al entendimiento de que la distancia entre el productor y el consumidor de alimentos orgánicos es considerable, lo cual no tiene que ser necesariamente cierto. En consecuencia se han desarrollado iniciativas orientadas a la utilización de canales comerciales cortos para la producción orgánica, basados asimismo en la participación de los agentes que los integran en los procesos de certificación. Dentro de este contexto destacan los Sistemas Participativos de Garantía (...) como modelos de certificación participativa en red, los cuales buscan potenciar la generación de confianza y el aprendizaje mutuo. El presente artículo tiene como objetivo describir los principios en los cuales se fundamentan, así como el funcionamiento, de los Sistemas Participativos de Garantía acorde con una estrategia de fomento de la participación comunitaria, la agricultura tradicional y el desarrollo rural endógeno. Research on grammatical gender processing has generally assumed that grammatical gender can be treated as a uniform construct, resulting in a body of literature in which different gender classes are collapsed into single analyses. The present work reviews linguistic, psycholinguistic, and neurolinguistic research on grammatical gender from different methodologies and across different profiles of Spanish speakers. Specifically, we examine distributional asymmetries between masculine and feminine grammatical gender, the resulting biases in gender assignment, and the consequences of these assignment strategies on (...) gender expectancy and processing. We discuss the implications of the findings for the design of future gender processing studies and, more broadly, for our understanding of the potential differences in the processing reflexes of grammatical gender classes within and across languages. Resumo: O texto é uma análise sobre a corrente crítica à relação entre direitos humanos e soberania popular no século XX, uma interpretação segundo a qual direitos humanos significam cada vez mais intervenção estatal e, em concomitância, seguem uma proceduralização da democracia. Ao contrário dessa posição, constatamos que direitos humanos, no momento atual, são impensáveis sem planejamento estatal, sem experts e funcionários estatais para efeito de sua implementação. Isso, se compromete a idéia clássica de soberania popular que supõe legislação política (...) por parte do povo, não a anula deveras: desde que não se pretenda manter a pureza clássica desse conceito, não parece ser incoerente pensar os direitos humanos, quando garantidos pelo Estado, como um meio, provavelmente o mais importante, de consolidação da vida democrática de um povo. Logo, se a concretização dos direitos humanos não admite ou não é acompanhada pela legislação do povo, é inegável, contudo, que é uma potencializadora de sua expressão, com o que, em decorrência, a relação entre Estado e sociedade civil não se manterá estática, podendo sofrer influências dos portadores de direitos.Palavras-chave: direitos humanos - soberania popular - Estado - sociedade civil - democracia.: The text is an analysis on the critical chain to the relation between human rights and popular sovereignty in century XX, an interpretation according to which human rights mean each time more state intervention and, in concurrence, follow a processing of the democracy. In contrast of this position, we evidence that if it cannot think about human rights without state planning, experts and state employees for effect of implementation of them. This, if compromises the classic idea of popular sovereignty that assumes legislation politics on the part of the people, does not annul it indeed: since that if it does not intend to keep the classic pureness of this concept, does not seem to be incoherent to think the human rights, when guaranteed for the State, as the way, probably most important, of consolidation of the democratic life of a people. Soon, if the concretion of the human rights does not admit or it is not followed by the legislation of the people, is undeniable, however, that it is an enabling to one of its expression, with what, in result, the relation between State and civil society will not remain static, being able to suffer influences from the carriers of rights. Porque Kant não definiu explicitamente o papel dos diversos sujeitos ligados entre si, pode-se verificar, como atual consequência, que alguns autores concebem o sujeito transcendental como um mediador entre mundo sensível e mundo inteligível, pelo que deixam de considerar que a ponte entre ambos mundos é estabelecida pelo juízo reflexionante. Com este texto é exposto que a lacuna deixada por Kant – o fato de ele não ter acentuado a ligação do homem em sua totalidade, ligação pela qual ele pode (...) ser compreendido entre ambos os mundos – tem por consequência interpretações atuais de sua teoria do sujeito que mantém ainda esta lacuna. This paper brings notes regarding Wittgenstein’s philosophy of language and its presence in habermasian philosophy by means of the basic concept language game. The approach of language of the second Wittgenstein reaches a rather culturalist abstraction, which, however, disclaims him of the pretension of being a theoretical of language, but in Habermas, this approach is put with an intention: the systematization of the universal pragmatics, which he presents as a theory of language games.

This paper offers a renewed construction grammar analysis of linguistic constructions in a diachronic perspective. The present theory, termedAgentive Cognitive Construction Grammar(AgCCxG), is informed byactive inference(AIF), a process theory for the comprehension of intelligent agency. AgCCxG defends the idea that language bear traces of non-linguistic, bodily-acquired information that reflects sémiotico-biological processes of energy exchange and conservation. One of the major claims of the paper is that embodied cognition has evolved to facilitate ontogenic mental alignment among humans. This is demonstrated by (...) the results of a corpus study in which the patterns of association between verbs, the particle UP and argument structure in Old and Middle English have been studied. The conclusion is that, similar to biological systems, the linguistic sign system displays patterns of equilibrium and non-equilibrium. In other words, while in Old English usage near equilibrium was reached through the use of a conservative set of constructional semiotic templates (attachment patterns), associated with motor modalities, Middle English displays high rates of randomness resulting in a less stable, yet distinct, system of constructional attachment. This paper analyses the probability of a reading so far neglected by editors in Lactantius Placidus’ late antique commentary on Stat. Theb. 5.16. Next, the article argues that, regardless of the accepted reading, this part of the scholium is likely an interpolation.

Mientras las lenguas yuto-nicaraos se expanden de Utah, EE.UU., a Nicaragua, los peregrinos del Cristo de Esquipulas viajan desde El Trifinio (Triángulo Norte de Centroamérica) a Chimayó (NM). Se exploran ambos bordes de un antiguo Virreinato al revelar su enlace por un Camino Real (entre realeza y realidad), cuyas señales olvidadas solo las reconoce una deposición testimonial subjetiva. En primer lugar, una crónica personal desglosa la extrañeza hispana (...) ante su propio legado en EE.UU., el cual los emparentaría con el Sur. En seguida, el ensayo comenta los enlaces culturales y lingüísticos ancestrales que mantienen tradiciones comunes —irreconocidas por nacionalismo cívico— entre el suroeste de los EE.UU. y el triángulo norte de Centroamérica.
